Using our services means that you agree to abide by our terms of use. That means that you will not infringe other Internet users’ rights, and will abide by the requirements of our network environment.

Our servers may not be used for illegal purposes. They may not be used for the transmission, storage, or distribution of any information, data, or material that either contravenes or directly facilitates the contravention of any applicable law or regulation, such as copyrighted material; trademarks; trade secrets or other intellectual property rights used without proper authorization; obscene or defamatory material, or material that represents an unlawful menace or breaches export rules. The foregoing list is illustrative and not exhaustive. Pirated software, hacker programs or archives, spoofing, phishing, Warez sites, MP3, spamming software and IRC bots are all prohibited.

Any attempt to undermine or cause any harm to a server or client is strictly prohibited.

Sites containing adult material, links to adult material, sex-oriented merchandise or pornography are not permitted. This includes sites that may infer sexual content, or link to adult content elsewhere. This is also true for sites that promote any illegal activity or content that may be damaging to our servers or any other server on the Internet. Links to such materials are also prohibited.

Any breach of system or network security may render you liable in criminal and/or civil law. This includes but is not limited to: unauthorized access, use, probing, or scanning of systems security or authentication measures, data, or traffic; interference with service to any user, host, or network including mail bombing, flooding, deliberately trying to swamp a system, broadcast attacks; forging of any TCP-IP packet header or any part of the header information in an email or a newsgroup posting.

Web hosting accounts that are judged to be adversely affecting server performance or network integrity will be shut down without advance warning.

It is strictly forbidden to use a Hostorange server or a Hostorange.com email address in connection with the sending of spam - unsolicited mass email messages. We will be the sole judge of whether this provision has been breached. This includes sending spam via another ISP or IPP which references a web site hosted on a Hostorange server, and offering for sale or distribution on your web site any software that can be used for spamming. If you breach this provision, your services will be deactivated immediately, without any refund.

Any client who acts in breach of any of our Terms of Use will have their account deactivated. We will be sole judge of what constitutes a breach. We reserve the right to remove any account without advance warning.

We will investigate all claims of a breach of our Terms of Use. During this time, it may be necessary for us to restrict your access to prevent further potentially unauthorized activity. We have sole rights to decide whether to restrict, suspend, or cancel your account and/or take appropriate action in the courts, according to the severity of the breach. If we suspect that a criminal offense has been committed, we will notify the appropriate criminal justice authorities.

We do not give credit for down time where services are disapplied as a result of a breach of our Terms of Use.

You agree to defend, indemnify and hold Hostorange harmless from any claims or liabilities resulting from the use of our services that damage you or any other party. We provide our service on an "as is, as available" basis without warranties of any kind, either express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose or non-infringement. We neither represent nor warrant that our service will be error-free, secure or uninterrupted. No statements made verbally or in writing by Hostorange, its employees, licensors or the like, will create a warranty; nor may you rely on any such statement. Neither Hostorange, nor its partners or suppliers will be liable for any cost, loss or damage arising either directly or indirectly from any transaction or use of the service.

Payments

Charges are expressed and payments must be made in US Dollars or Euros.

We accept payments by:

• Credit cards (VISA, MasterCard, American Express)

All payments are due on the Account Statement Date, which is the yearly anniversary of the date your account was activated. We do not automatically renew the accounts. Any account not paid within the due date will be suspended without notice.

We will proceed with the account(s) activation and registration of the domain name(s) only after receiving of the proof of payment.

Any features added to an account are charged monthly, and are strictly non-refundable.


Cancellations

You can cancel your plan through Hostorange's billing service. You can contact them on sales@hostorange.com or www.supportmyhost.com and they will advise you what to do.

HostOrange will not screen and will not automatically cancel hosting plans for problems with domain name transfers, non-usage, Internic, your ISP, or other problems, which are not directly connected with its services.

HostOrange has the right to cancel any account at any time without notice if it considers to have reasonable cause to do so.

All our web-hosting plans come with a full 30-day money back guarantee. If you are not fully satisfied with our services or support within the first 30 days, we will offer you a full refund of the fees paid upfront when your plan is cancelled.

Please note that the domain name registration service is not covered by our 30-day money back guarantee.

Accounts cancelled or deactivated by Hostorange for breach of our Terms of Use - e.g., sending unsolicited bulk mail - are not covered by the 30-day money back guarantee.


Refunds

We only give refunds within the first 30 days of account activation. Refunds will be made by the same method as your original payment. After 30 days, no refunds are available.


Credit Card Disputes/Chargebacks

HostOrange does not accept chargebacks. If you challenge a valid credit card payment, Hostorange may suspend or deactivate your account. In any event, if a chargeback is made, a 10% administration fee will be charged.

Our policies and prices are subject to change without notice. Any price changes will take effect as of the billing cycle following the change.
